The Federal High Court,Awka presided over by Hon Justice H.A Nganjiwa has slammed a N100,000 cost against the Rock of Fire Global Ministries and the Onitsha South Landlords Association over delay tactics and frequent adjournment of the matter.Both are laying claims to the Ugborimili Primary School,Onitsha South Local Govt Area and also challenging the Anambra State government and the Archdiocese of Onitsha over ownership of the school. The Federal High Court, sitting in Awka, heard arguments from Barr Azubike Anazor, Senior Counsel for the Catholic Archdiocese of Onitsha urging the Court to terminate the proceedings instituted by Onitsha South Landlords Association and Rock of Fire Global Ministries as Applicants against the Anambra State Government and the Catholic Archdiocese of Onitsha as Respondents over return and ownership of Ugborimili Primary Schools, Housing Estate, Fegge, Onitsha. Barr Anazor, appearing for the Catholic Church, stated that the case was slated for definite hearing but has suffered unnecessary delays. He referred the Court to a plethora of judicial authorities to buttress his position that the suit was dead on arrival and was liable to dismissal. Counsel for the Applicants, Barr C.O Ogugua, was not able to counter the legal issues canvassed by Barr Anazor and sought for an adjournment for the umpteenth time. Azubike Anazor opposed any further adjournment marshalling out long list of previous adjournments at the instance of the Applicants and contended that anyone initiating a case in court should be prepared to prove their case and not be seeking endless adjournments. The Court, presided over by Justice Nganjiwa agreed with Barr Anazor and awarded another cost of N100,000 against the Applicants in favour of Onitsha Archdiocese. Further hearing is adjourned to June 21 2022.
